GENERAL TERMS AND CONDITIONS FOR BOOKING
AND STAY IN TOURIST ACCOMMODATION
PURPOSE:
These terms and conditions regulate the booking of tourist accommodation services and the rules of use and cohabitation for all clients who reserve or stay at the specified property. The service consists exclusively of the temporary rental of accommodation for tourism or holiday purposes, without any right to permanent residence.
ACCEPTANCE:
The formalisation of a booking or stay implies full acceptance of these general conditions, which are permanently available on the website.
DATA PROTECTION:
Personal data provided by the client will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and the LOPDGDD 3/2018, for the purpose of managing the booking, invoicing, and legal obligations. The data subject may exercise their rights of access, rectification, and erasure by written request to the controller’s email address.
CONTACT TELEPHONES:
- Contact numbers for the property are available in the ground floor lounge should they be needed.
- Emergency security and medical numbers, as well as contacts and addresses of interest such as pharmacy, supermarket, and cash machine, can also be found in the same lounge.
BOOKING PROCEDURE:
- The client may make a booking via the website form, email, or associated booking platforms.
- The minimum stay required for a booking is two nights. The booking will only be confirmed once the client has received written confirmation and made payment of the deposit or reservation fee.
- At the time of booking, a 50% payment of the total stay will be requested via bank transfer. The booking becomes effective upon receipt of the transfer and written confirmation. The remaining 50% must also be paid by transfer at least 14 days before the arrival date.
- Upon formalising the booking, the general terms and conditions are accepted.
- The details entered by the client must be real and verifiable. Any error or omission may result in the booking being cancelled.
CANCELLATIONS:
- Bookings may be cancelled with a 100% refund if made at least 15 days before the arrival date.
- Cancellations between 8 and 14 days before arrival entitle the client to a 50% refund.
- Cancellations with less than 8 days’ notice are non-refundable.
- El Secret de Prades reserves the right to rectify or cancel bookings in cases of fraud, error, or force majeure.
NUMBER OF OCCUPANTS:
• Only the number of people indicated in the booking may stay at the property. Visits, parties, events with non-resident persons, transfers to third parties, or subletting are not permitted.
CHECK-IN AND CHECK-OUT
• Check-in: On the day of arrival, check-in is available from 16:00 to 20:00. Arrivals outside these hours must be requested and approved by the property at least 5 days in advance. Unauthorised late arrivals may incur a surcharge of €25 per hour or part thereof after 20:00.
• Check-out: Check-out must be completed by 11:00 on the day of departure, with the time to be agreed in advance with the manager. Additional time beyond the agreed check-out results in a €25 surcharge per hour or part thereof. The apartment and house must be left in good condition, tidy, and clean.
• Late Check-out: Late check-out after 11:00 must be requested at the time of booking, is subject to availability, and will incur a €30 surcharge per apartment. In no case may check-out be later than 16:00 on the departure day.
TOURIST TAX
• The tourist tax will be applied in accordance with Decree-law 6/2025 of the Generalitat de Catalunya.
IDENTIFICATION:
• All guests are required to provide personal identification for police control as required by law (ORDER IRP/418/2010, 5 August, on the obligation to register and report guests to the Police Directorate General in Catalonia).
• The guests must appoint a person responsible for the booking, who will provide the details of all occupants. This person will sign the guest register book, confirming the accuracy of the information provided.
PETS:
• Pets are not allowed anywhere on the property, indoors, on the terraces, or in outdoor areas. This prohibition is clearly stated, and any breach will result in an additional charge deducted from the deposit for extra cleaning and/or damage repair. If pets are detected by the property during the stay, guests will be required to remove the animal immediately.
SMOKING:
• Smoking and the use of vapes are not permitted anywhere inside the house. Ashtrays are provided on the tables on the rear terrace, where smoking is allowed. It is forbidden to throw cigarette butts on the ground in outdoor areas. Failure to comply with this rule will result in an additional charge for extra cleaning costs, which will be deducted from the deposit.
INCLUDED SERVICES:
• The price includes: exclusive use of the accommodation and its facilities, water, electricity and heating supplies, and basic linen, bath, and kitchen equipment. Additional services may incur extra costs.
WASHING MACHINE AND DRYERS:
• All three apartments have a washing machine and there is a drying rack with pegs available in the parking area.
WIFI
• There is free wifi for guests throughout the house. Passwords are available in the apartments and in the ground floor lounge.
RULES OF USE AND COHABITATION:
• The client and their companions must behave in a civil manner, respecting general rules of cohabitation and the municipal regulations of Prades.
• Any activity that disrupts the normal cohabitation of the community where the accommodation is located, such as loud music, noise or parties, and which provokes justified complaints from neighbours, will be grounds for immediate eviction. Without refund of the amount paid for the stay.
• Quiet hours are from 22:00 to 09:00 every day of the week; during these times, any activity that disturbs rest is strictly prohibited.
• In the event of any breach of the obligations mentioned in this document, the person in charge may, at their discretion, require the client to vacate the apartment or apartments. In such a case, the client will not be entitled to any financial compensation or indemnity of any kind.
RESPONSIBILITIES:
• The owner is not responsible for theft, loss or damage to personal belongings, nor for damage caused by external factors or force majeure.
• Guests undertake to leave the accommodation in a suitable condition and to respect basic rules of cohabitation and safety.
• Prades is a safe village; however, the property is not responsible for the loss or forgetting of clients’ belongings. The house has an alarm system and exterior video surveillance, but these are only active when there are no guests.
• Guests are responsible for keeping their belongings, as well as property fixtures, safe by controlling who they allow access to and by keeping the property’s access doors closed.
•The client is responsible for any direct or indirect damage that may result from improper use of the apartment or common areas, including but not limited to: damage, losses due to fire, theft or criminal acts, with the client being solely civilly liable and required to respond to any legal action resulting from their actions. If the property has to answer for damages caused by the client, it will have recourse against the client to recover any expenses, compensation or indemnities paid to third parties.
DEPOSIT:
• At the time of making the second payment for the reservation, a deposit of €100.00 per apartment and €400.00 for the entire house must be made by bank transfer. This will be refunded within a maximum of 10 days after departure, provided no damage, defects or additional charges are found. Otherwise, a total or partial charge may be made. The return of the deposit will be made by transfer to the account number provided by the clients.
CLEANING SERVICE:
• The cleaning service is €60.00 per apartment and €180.00 if the entire house is rented. This service is not included in the booking price and must be paid at check-in.
PARKING AREA:
• The parking area can accommodate up to 5 cars, and the access gate is opened and closed manually. Guests must ensure a free area is left for manoeuvring and turning vehicles.
• It is recommended to park cars facing the exit upon entry, as reversing out is dangerous due to a downhill curve with poor visibility.
• The property is not liable for any damage suffered by the vehicles of guests or their occupants, nor for any damage that may be caused to third parties during entry, exit or manoeuvring in the parking area.
• Parking is for the exclusive use of guests; no vehicles belonging to non-guests may be parked.
• The apartments on the first and second floors each have two parking spaces, and the ground floor apartment has one.
KEYS:
• Loss of keys will incur a charge of €85 per set, plus delivery costs.
ORDER:
• When sharing a stay occupying more than one apartment, all items must be left in the apartment and in the place where they were found. Otherwise, a charge will be applied for returning items to their place.
• The same criterion applies to common areas and terraces: furniture and objects must be left as they were on arrival.
WINDOWS AND BALCONY DOORS:
• All the house’s balcony doors and windows are of high quality with maximum thermal, acoustic and security insulation and are delivered in perfect condition. Please use the opening and closing mechanisms responsibly and carefully to avoid damage, faults or breakages. If these occur due to incorrect or irresponsible use, repair costs will be deducted from the deposit.
HEATING SYSTEM:
• Following the recommendations of the World Health Organisation, the heating temperature is set at 21–22ºC during the day and between 17–18ºC at night throughout the house. Both are internationally accepted comfort temperatures. The thermostats in the apartments and the ground floor lounge cannot be adjusted; if guests require a change, they must contact the administrator by phone.
BARBECUES:
• There are three portable barbecues, firewood, and barbecue and cleaning utensils available for guests. These must be requested in advance and a supplement of €35.00 per unit is paid at check-in, which includes cleaning, firewood, and use of the barbecue utensils.
POOL:
• The pool on the rear terrace is suitable for swimming and can be used by guests during the summer months. There is no lifeguard service at the pool, so users assume all responsibility for its use. Next to the pool is a solar shower for guests to use before or after bathing. The pool must be kept clean and left in the same condition as it was found.
FRIDGES:
• The fridges in the apartments are delivered running and empty. There is a labelled switch to turn them off. The property is not responsible for the loss of food due to accidental disconnection of the fridge.
• On departure, fridges must be left clean, without food or packaging.
INDUCTION COOKERS:
• The kitchens in all three apartments are induction, so only equipment suitable for induction should be used.
BLUETOOTH SPEAKER:
• There is a wireless speaker in the ground floor lounge and in the second-floor apartment for guests’ use, provided it is used correctly and the rest of the guests and neighbours’ rest is respected. These are not for outdoor use.
FIRE EXTINGUISHERS AND EMERGENCY LIGHTS:
• There are four fire extinguishers installed next to each wood-burning stove. There are also emergency lights at the exit from the ground floor lounge to the front terrace and street, and on the stairs to facilitate evacuation in an emergency.
MAIN ELECTRICAL PANEL:
• The main electrical panel for the house is in the ground floor lounge. The larger apartments have their own panels. Guests may access them in case protections are triggered by storms or surges.
WOOD-BURNING STOVES:
• In winter, guests may light the wood-burning stoves located in the apartments and in the ground floor lounge. Utensils for their use, as well as firewood, are available.
HANDMADE CLAY FLOORS AND RUGS:
• As this is a building considered of National Interest, guests must take special care to avoid dirtying or damaging the handmade clay floors, as well as the rugs that protect them.
RECYCLING AND RUBBISH:
• The house has a recycling area next to the sliding vehicle access door. Similarly, both the apartments and common areas have bins for waste segregation.
• Guests are responsible for separating waste and, on departure, placing bags in the correct bins in the recycling area.
• There are extra rubbish bags in the apartment kitchens.
• Take special care not to break glass bottles when putting them in the glass container. If rubbish is not fully collected, not recycled, or not placed in the bins, the additional cost of carrying out this service will be deducted from the deposit.
INVENTORY:
• El Secret de Prades has a detailed inventory of furniture, appliances, household items and other elements made available to guests in the apartments and common areas. This inventory forms an integral part of the contract and is provided in digital format upon arrival to the person responsible for the reservation. On arrival, the client has a period of 8 hours to report any incident or missing item from the inventory or any existing damage. Otherwise, it will be understood that everything is in good condition. On departure, the owner or a designated person may check the state of the property and compare it with the initial inventory.
• The client will be responsible for any damage, loss or deterioration that occurs during the stay and which is not due to normal use or wear and tear. If anomalies are detected, the owner may deduct the corresponding amount from the security deposit or claim it according to the repair or replacement estimate.
